NDRC Announcement regarding the Improvement of Wind Power Tariff Regulations
To Provincial Development and Reform Commissions and Price Bureaus:
In accordance with the Renewable Energy Law of the People's Republic of China, NDRC has decided to further improve those relevant regulations originally defined in the NDRC's Provisional Administrative Measures on Pricing and Cost Sharing for Renewable Energy Power Generation (NDRC Price [2006] No.7). These amendments aim to regulate wind power prices so as to ensure smooth and sustainable development of the wind power industry in China; they read as follows:

    I. Regulation of Wind Power Price Management Procedures
   
(1)    Benchmark feed-in tariffs for onshore wind power shall be set for specific wind resource regions. In proportion to wind resource and project development conditions, it has been decided to split the national territory into four wind resource regions and set benchmark prices for wind power accordingly. The standard wind power tariffs for each wind resource region are outlined in the Annex Table.
The benchmark feed-in tariffs shall apply for all newly developed onshore wind power projects, including those projects developed at Tantu areas above the average high tide lines and installed on islands permanently inhabited. Wind farms installed around inter-province border areas shall principally adopt the benchmark price applicable to the higher priced of the relevant provinces.
(2)    Tariffs for grid-connected offshore wind farm projects shall be determined according to offshore wind power development.
(3)    A wind power project invested at provincial level and approved by the provincial level energy administration must register to the National Development and Reform Commission and the National Energy Administration.

II. Implementation of the Wind Power Cost Sharing Policy

    The portion of a wind power tariff that comes under the benchmark price for local desulfurized coal generation shall by paid by local grid enterprises. The larger portion will be subsidized by the renewable energy tariff surcharge levied on all users. If the benchmark price for local desulfurized coal generation is adjusted, the portion of the tariff paid by local grid enterprises will also be adjusted.   
 
III. Specific regulations
(1)    The above regulations come in effect as of August 1st, 2008. For those wind farm projects approved before this date, tariffs will remain as they were previously verified.
(2)    Renewable energy power generation and grid enterprises shall record and maintain, on a genuine and complete basis, all relevant data; such as trade volume, price, and the amount of power generated from renewable energy to the grid. They shall also accept any inspection and supervision by administrative authorities. Price authorities at all levels are to strengthen their management over the settlement of wind power tariff surcharge so as to ensure complete implementation of the wind power tariff regulations.
